BOWL EXPO TRIVIA SWEEPSTAKES OFFICIAL RULES
- HOW TO ENTER: NO PURCHASE NECESSARY. The Bowl Expo Sweepstakes (the “Sweepstakes”) begins at 12:01 a.m. Central Time on April 25, 2008 and ends at 11:59 p.m. Central Time on May 23, 2008 (the “Entry Period”). To enter, visit www.bowlexpo.com (the “Sweepstakes Site”) and complete the on-line Official Entry Form during the Entry Period. Limit one entry per person. Entries must be received by 11:59 PM Central Time on May 31, 2008. Entrants may be asked to answer several optional questions, however, whether these questions are answered or not will not impact eligibility for the Sweepstakes. For additional copies of the Official Rules, please send a self-addressed stamped envelope to: Bowl Expo Trivia Official Rules at BPAA, 615 Six Flags Drive, Arlington, TX 76011 (the “Sweepstakes Address”). Requests must be received by May 14, 2008. Official Rules will also be posted at the Sweepstakes Site during the Sweepstakes. The Sweepstakes is sponsored by the Bowling Proprietor's Association of America (“Sponsor”). The Sponsor assumes no responsibility for any computer, software, online, Internet or technological malfunctions. If for any reason the Sweepstakes is not capable of being conducted as contemplated in the Official Rules, including if due to computer virus, bugs, tampering or technical failures which compromise the administration or integrity of the Sweepstakes, Sponsor, in its sole discretion, reserves the right to terminate or modify the Sweepstakes. In the event of a dispute regarding the identity of an entrant, entries will be declared to have been made by the “Assigned Account Holder,” that is, the individual person who is assigned the email address corresponding to the winning entry. All entries become the property of the Sponsor and none will be returned. Sponsor and Sweepstakes judges reserve the right to disqualify any entrant who tampers or attempts to tamper with the entry procedure or the Sweepstakes Site or violates these Official Rules.
- PRIZES: After applicable verification and subject to compliance with these Official Rules, ONE (1) GRAND PRIZE WINNER (the “Winner”) will receive the following Grand Prize (the “Grand Prize”) for himself or herself. Guest must be age twenty one (21)or older and must agree to be bound by these Official Rules and must sign a release consistent with that set forth in Section 4 in these Official Rules as a condition to receipt of and/or participation in the Grand Prize. The Grand Prize is a full registration for the winner. Approximate maximum retail value of the Grand Prize Two Hundred and ninety nine Dollars ($299). No transfer or substitution of prizes permitted except where required by law. If the Grand Prize, or any portion of such prize, becomes unavailable, the Sponsor may award a substitute prize of equal or greater value. Odds of winning the Grand Prize depend upon the number of eligible entries received. Taxes on the Grand Prize are the sole responsibility of the Grand Prize Winner, as the case may be. All expenses, costs and fees not expressly included above are the sole responsibility of Grand Prize Winner and Guest as the case may be.
- ELIGIBILITY: The Sweepstakes is open to legal residents of the fifty United States and the District of Columbia who are twenty one (21) years of age or older at the time of entry and must be a current member of the Bowling Proprietor's Association of America. Entry in the Sweepstakes constitutes an entrant’s agreement to be bound by these Official Rules. Entrants agree to be bound by the decisions of the Sweepstakes judges and such decisions shall be final.
- WINNER SELECTION AND NOTIFICATION: A tentative Grand Prize Winner will be selected in a random drawing to be held on or about May 26, 2008 and conducted by an independent accounting firm appointed by Sponsor. Such tentative Grand Prize Winner will be notified via Certified U.S. Mail and/or telephone and/or e-mail on or about the week of May 30, 2008. Such person, at his or her sole discretion, may disclaim the Grand Prize by not claiming such prize or by not completing and returning to Sponsor, the Sponsor’s Affidavit of Eligibility and Liability and Publicity Release within fourteen (14) days of attempted notification and in such case an alternate winner will be selected and this process will be repeated until such time as a tentative Grand Prize Winner completes and returns to Sponsor the Sponsor’s Affidavit of Eligibility and Liability and Publicity Release within fourteen (14) days of attempted notification. At such time, subject to verification by the Sweepstakes independent accounting firm, the tentative Grand Prize Winner will be deemed the Grand Prize Winner. By entering this Sweepstakes and by accepting a prize, the Grand Prize Winner agrees that Sponsor, the independent accounting firm, and their respective parents, affiliates, subsidiaries, and the officers, directors, agents and employees of any of the above entities are not liable for injury, loss, death, or damage of any kind due to or associated with acceptance, possession, use or misuse of the Grand Prize and/or participation in this Sweepstakes. Except where prohibited by law, Grand Prize Winner further grants to the Sponsor the right to use such Grand Prize Winner’s name, photograph, voice, likeness and city of residence for purposes of advertising or promoting and publicizing the efforts and activities of the Sponsor without further consideration and to release his or her name to persons requesting the names of the winners of the Sweepstakes. Non-compliance or the return of any prize notification as undeliverable may result in disqualification and selection of an alternate winner.
- NAME OF WINNER: For the name of the Grand Prize Winner, available after June 9, 2008 and before August 31, 2008, send a self-addressed stamped envelope (except where not required by State law) to: Sweepstakes Winner’s List at the Sweepstakes Address.
- PRIVACY: All information submitted as part of this Sweepstakes will be treated in accordance with Sponsor’s Privacy Policy. By entering the Sweepstakes, each entrant agrees to receive promotional materials from the Sponsor. Entrants may opt-out from receiving Sponsor’s promotional materials in accordance with the Privacy Policy
- RELEASE AND LIMITATIONS OF LIABILITY: By entering the Sweepstakes, entrants agree to release and hold harmless Sponsor, its affiliates, subsidiaries, advertising and promotional agencies and its and their officers, directors, employees and agents (the “Sweepstakes Parties”) from and against any claim or cause of action arising out of participation in the Sweepstakes or receipt or use of any prize. Each entrant further agrees that in any cause of action, the Sweepstakes Parties’ liability will be limited to the cost of entering and participating in the Sweepstakes, and in no event shall the Sweepstakes Parties be liable for attorneys’ fees, punitive, consequential, direct or indirect damages and each entrant waives the right to claim any damages whatsoever.
- DISPUTE RESOLUTION: Except where prohibited by law, each entrant agrees that any and all disputes, claims and causes of action arising out of or in connection with the Sweepstakes shall be resolved individually, without resort to any class action, exclusively by the courts located in the judicial district including Arlington, Texas. All issues concerning the construction, validity, and interpretation of these Official Rules shall be governed by and construed in accordance with the laws of the State of Texas (and federal laws, as applicable), without giving effect to any choice of law or conflict of law rules that would result in the application of the laws of any jurisdiction other than the laws of the State of Texas and applicable federal laws.
- VOID WHERE PROHIBITED. The Sweepstakes is VOID WHERE PROHIBITED.
